Terms of Service

These Terms of Service ("Terms") govern your use of the NES AI Platform ("Platform") operated by New Essential Services SPC ("NES", "we", "us", or "our"), a company registered in the Sultanate of Oman. By registering for or using the Platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the NES AI Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Platform on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.

3. Pricing, Plans & Founder Discount

The first 50 registered clients ("Founders") receive a 50% discount on their chosen plan. This discounted rate is locked in for 1 year from the date of signup. After the founder pricing period expires, billing will automatically revert to the then-current standard rates unless you cancel or renegotiate your plan.

Current Founder Prices (50% off):

Setup Fee: A one-time OMR 99 setup fee applies to new accounts. This fee is waived for all Founder clients during the founder window (first 50 clients).

All prices are in Omani Rials (OMR) and exclude VAT where applicable. NES reserves the right to adjust standard pricing with 30 days' written notice. Founder pricing is protected for the 1-year period as stated above.

4. Free Trial

All plans include a 7-day free trial from the date of account activation. No payment is required during the trial period. At the end of the trial, your account will be reviewed by the NES team and you will be contacted to complete onboarding and activate your paid subscription. You may cancel at any time during the trial at no charge.

5. Payment Terms

Subscriptions are billed monthly in advance. Payment is due on the same date each month as your original activation date. NES accepts payment via Thawani (Oman) and international card payments. Accounts with overdue payments of more than 7 days may be suspended. A 15% discount is available for annual prepayment of any plan.

6. Cancellation & Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period โ€” you retain access until that date. NES does not offer pro-rata refunds for partial months. Refund requests for exceptional circumstances will be reviewed on a case-by-case basis by the NES management team.

7. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You agree not to share login access between multiple organisations. You are responsible for all activity that occurs under your account. You must notify NES immediately of any unauthorised use of your account.

The Platform includes AI voice agents (Sara, Layla, and Adam) powered by third-party voice AI providers. These agents are configured and operated by NES on your behalf. You acknowledge that:

10. Intellectual Property

All Platform software, design, branding, and underlying technology remain the intellectual property of New Essential Services. Your data and content remain yours. You grant NES a limited licence to process your data solely to provide the Platform services.

11. Service Availability

NES targets 99% uptime but does not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible. NES is not liable for downtime caused by third-party infrastructure providers (Hostinger, Supabase, Vapi, Meta, etc.).

12. Data Retention

Upon cancellation or account termination, your data is retained for 30 days before permanent deletion. You may request an export of your data within this window by contacting office@essential-services.org. After 30 days, all data associated with your account is permanently deleted from NES systems.

13. Limitation of Liability

To the maximum extent permitted by Omani law, NES shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total liability to you shall not exceed the amount you paid to NES in the 3 months preceding the claim.

14. Governing Law

These Terms are governed by the laws of the Sultanate of Oman. Any disputes shall be subject to the exclusive jurisdiction of the courts of Muscat, Oman.

15. Changes to Terms

NES may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
